I am a firm believer that things to happen for a reason. I become more and more aware of this as I get older. Like take for example - Walking into Macy's to buy a pair of shoes for a (3) Communion parties this Saturday and finding the exact ones ON SALE and in MY size - it was clearly meant to be! Here is another one - I don't or I won't miss any of my kids baseball games this weekend because oddly - they were all scheduled for Sunday in the afternoon and not Saturday (the day that I have marathon Communion Parties), THAT was meant to be!

I had a buyer ask if he could do some work in a home that he will be closing on soon - but not yet. He is feeling stressed for time and he thought that if he could get into the home prior to closing, he could start on some painting and odds and ends. I think he got a bit upset with me when I told him he could not enter the home to "paint and do odds and ends". I told him that this was not even an option for him right now. Its not that I did not know why I told him he couldn't work in the home - I just did not know how to explain it to him.
Now I can - Why Pre- and Post-Possession is a No-No - Zillow Blog (ok, the article is about moving into the home - but my point is LIABILITY.... Where and with who would it lie with? )
See, I told you things happen for a reason!
My clients hated when I advised not to allow pre or post occupancy. But in a few cases it could not be avoided. That's when you need a good real estate attorney.

Well, now we are getting down to the wire. The buyers of the new construction home (my buyers) are anxious and the buyers of their home are double anxious - The problem I have with this is that we have not even gotten the C/o on the new construction home. We are to have the walk through today.
Mr. Sellsius - what situations did you come across that could not be avoided? What or how did this work and what legalities were involved?
